Question: What curfews are in effect in Austin?

There are several different curfews - times when children and teens, or both minors and adults are prohibited from being out and about or in certain locations or engaging in certain activities. Most Austin curfew violations are a Class C misdemeanor.

Answer: Park Curfew: 10:00 PM - 5:00AM
This curfew applies to adults and children in most city parks and on the hike and bike trails around Austin. The curfew is posted at all parks.

City-wide Daytime Juvenile Curfew: 9:00AM - 2:30PM M-F
During normal Austin Independent School District (AISD) school hours, unsupervised minors age 10-16 years old are not allowed in public places.
Exceptions include:

  • teens with a high school diploma (or equivalent)
  • excused absences
  • school holidays (including summer recess)
  • off-campus lunch
  • home school children

Austin City Code of Ordinances 9-3-2 (F) specifies that a minor commits a violation of the daytime curfew if the minor "remains, walks, runs, idles, wanders, strolls, or aimlessly drives or rides about in or on a public place between 9:00 a.m. and 2:30 p.m. on Monday, Tuesday, Wednesday, Thursday or Friday" Subsection (G) also states that parents also commit a violation of this Austin City Code of Ordinances if they knowingly allow their teens and pre-teens to violate curfew.

City-wide Nighttime Juvenile Curfew: 11:30PM - 6:00AM Sun-Thurs; 12:30AM - 6:00 AM Sat-Sun
Unsupervised children and teens under the age of 17 are not allowed on the streets or in public places during the nighttime curfew hours. Being outside their own home, a neighbor's home, or that of a relative is allowed (if the residents have no objections). If the weekday precedes an AISD holiday or during AISD summer recess, the Sat-Sun curfew hours apply.

Downtown Juvenile Curfew: 10:00PM - 6:00AM
Unsupervised children under the age of 17 are not allowed on the streets or other public places in designated parts of downtown or in the warehouse district. Note that the downtown curfew starts earlier than the general city-wide nighttime curfew.

  • Downtown Curfew Area 1: that area bounded by the south curb of Tenth Street, the east curb of the IH-35 West Frontage Road, the south curb of Fourth Street, the east curb of Congress Avenue starting at Fourth Street, south to the south curb of Second Street (West), the west curb of San Antonio Street, the north curb of Seventh Street (West), and the west curb of Congress Avenue.

  • Downtown Curfew Area 2: that area bounded by the south curb of Fourth Street (West), the west curb of Rio Grande Avenue, the north curb of Seventh Street (West) and the west curb of San Antonio Street.

Southeast Austin Juvenile Curfew: 11:00PM - 6:00 PM Sun-Thurs; Midnight - 6:00 AM Fri-Sat
In Area 3 east of IH35 and south of Ben White Boulevard (signs are posted), minors under the age of 17 cannot be out on the streets in public places or on the premises of any establishment in the area except under the supervision of a parent or guardian.

    Curfew Area 3: that area bounded by the east curb of the IH-35 East Frontage Road, the south curb of Ben White Boulevard (East), the west curb of U.S. Highway 183, the north curb of Scenic Loop and the north curb of the proposed extension of Slaughter Lane.

Water Utility Property Curfew: 9:00PM - 6:00AM
Only authorized persons are allowed access to Austin Water Utility property during curfew hours if a sign stating that entry is prohibited is posted at the property.

Alcohol Purchase Prohibition: Sunday 2:00AM - 12:00 Noon; Mon-Sat 2:00AM - 7:00AM
Not exactly a curfew but you cannot buy beer or mixed alcoholic beverages until after noon on Sundays or before 7:00AM on other days.

Alchohol Consumption Prohibition: Sunday 2:15AM - 12:00 Noon; Mon-Sat 2:15AM - 7:00AM
Consuming or "holding for the purpose of consumption" an alcoholic beverage in a public place is prohibited during the designated hours.

Charitable Solicitation Prohibition: 9:00PM - 9:00AM
The city prohibits the solicitation for a charitable cause by telephone or by going to the door of a residence during these hours.
